  3. Will I have to be in the room with the other side? No. Unless the attorneys agree in advance, the parties will start (and stay) in separate rooms.
  4. What are some of the keys to a successful mediation? The timely submission of a mediation statement is a great start.
  5. Does the mediator decide what the case is worth? No. The value of attending mediation is that the parties, rather than a judge or jury, decide what the case is worth. The mediator helps the parties reach that agreement.
  6. My lawyer told me the mediation will be on Zoom. Is this normal? Yes. Zoom mediations became common in 2020 and have continued to be the norm since then.
